Повереник за информације од јавног значаја и заштиту података о личности  оцењује да пораст, и иначе константно великог. броја жалби које  грађани, медији и остали подносе Поверенику указује на забрињавајући однос многих органа власти према правима утврђеним Закона о слободном приступу информацијама и Закона о заштити података о личности.

Оцењујући да се тзв. „предизборном атмосфером“ такав однос можда може „објашњавати“ али не и оправдати, Повереник је нагласио да је примарни, основни задатак органа власти извршавање закона и у оквиру тога остваривање и заштита права грађана и да се пропуштање те обавезе ничим не може правдати.

С тим у вези, повереник Родољуб Шабић је изјавио и следеће:

Mr. Rodoljub Sabic, Commissioner for Information of Public Importance and Personal Data Protection, congratulated today in letters addressed to the Journalists’ Association of Serbia (UNS), the Independent Journalists’ Association of Serbia (NUNS) and the Independent Journalists Association of Vojvodina (NUNV) the World Press Freedom Day, 3 May, to all journalists in Serbia. Expressing his best wishes for continued success in the work of journalists and the media, the Commissioner reaffirmed his readiness and duty to help them carry out their important social function.  

In that regard, Commissioner Rodoljub Sabic also said the following:

Commissioner for Information of Public Importance and Personal Data Protection, Rodoljub Sabic has sent to the Ministry of Finance - Tax Administration a Warning in which he shows that the Tax Administration in the implementation of the Law on Free Access to Information of Public Importance is for a longer time now continuously breaking not just the provisions of this Law, but also provisions of the Law on Data Secrecy and the Personal Data Protection Act.

Stressing that the Tax Administration is almost regularly denying information to the media, journalists, citizens and to all other seekers, that is, it discloses them just after the order of the Commissioner, and sometimes not even then, the Commissioner, Rodoljub Sabic has also stated the following:

Commissioner for Information of Public Importance and Personal Data Protection, Rodoljub Sabic has received today Mrs. Natasa Pirc Musar, Commissioner for Information of the Republic of  Slovenia. Thus has officially started implementation of the project „Enhancing Personal Data Protection in Serbia“ so-called Twinning Light, financed by the European . 

In relation to that, the Commissioner, Rodoljub Sabic also stated the following:

The Commissioner for Information of Public Importance and Personal Data Protection Rodoljub Sabic has warned the Ministry of Interior of the Republic of Serbia (MoI) that the publication, without lawful authority or consent, of the photographs and video records of persons deprived of liberty and the textual data determining the identity of the persons, constitutes unlawful processing of personal data. 

In this regard, the Commissioner, Rodoljub Sabic has stated the following:

The Commissioner for Information of Public Importance and Personal Data Protection has submitted to the National Assembly of the Republic of Serbia the Report on the Implementation of the Law on Free Access to Information of Public Importance and of the Law on Personal Data Protection for 2011. The regular report, which is annually submitted by the Commissioner within three months of the end of the previous year, has also been placed on the Commissioner’s web site http://www.poverenik.org.rs/index.php/sr/doc/izvestaji.html. the same report has been,  pursuant to the Law, forwarded to the President of the Republic, the Ombudsman and the Government of the Republic of Serbia.

Emphasizing the continued trend of more intensive citizen’s complaints to the Commissioner for the purpose of protection of their rights and that in 2011 more new cases have been processed, and only in the field of access to information, which is % more than in the previous year, i.e. times more than in 2005, the Commissioner Rodoljub Sabic has emphasized:

In a letter submitted to the National Assembly, the Government and a number of Ministries, the Commissioner for Information of Public Importance and Personal Data Protection provided the latest version of a document prepared by the Bureau of the Consultative Committee of the CoE Convention 108 for the Protection of Individuals with regard to Automatic Processing of Personal Data and invited these authorities to give their contribution to the improvement of planned amendments to and modernization of this truly fundamental international document in the field of personal data protection.

In that regard, Commissioner Rodoljub Sabic also said the following:

The Commissioner for Information of Public Importance and Personal Data Protection completed the planned preventative supervision of the implementation and execution of the Law on Personal Data Protection at the Ministry of Internal Affairs of the Republic of Serbia. Successive submission of records containing results of performed supervision to all organizational units of the Ministry of Internal Affairs included in the supervision has been completed today.

Emphasizing that it was an activity which had not been performed in Serbia before and which should give significant contribution to the improvement of personal data protection, Commissioner Rodoljub Sabic also said the following:

The Commissioner for Information of Public Importance and Personal Data Protection said that it would be highly detrimental from the aspect of exercise and protection of human rights if the current convocation of the National Assembly of the Republic of Serbia failed to enact certain laws which had been drafted much earlier and the enactment of which is not hindered by any justified reason until the new convocation is sworn in.

The Commissioner underscored in particular the immense importance of adoption of the Law on General Administrative Proceedings, the Law amending the Law on Ombudsman and the Law amending the Law on Extrajudicial Proceedings and recalled that several more laws are in parliamentary procedure, the adoption of which would be very useful both from the aspect of the achievement of priorities within EU integration and from the aspect of improvement and protection of Serbian citizens’ rights, the latter being particularly important.

In that regard, Commissioner Rodoljub Sabic also said the following:

In a letter sent today to the Minister of Health, Mr. Rodoljub Sabic, Commissioner for Information of Public Importance and Personal Data Protection, emphasized the necessity and urgency of passing the secondary legislation envisaged by the Law on Organ Transplantation in order to address open issues regarding personal data protection in the field of organ donation.

Saying it was unacceptable that the other side of the coin of organ donation, a very important activity from the human aspect which had been the subject of numerous promotional campaigns, was a lack of proper legal arrangements and non-compliance with the law, i.e. shortcomings which could be the source of serious risks of mass violation of basic human rights and reminding that he drew the attention of the Ministry of Health to the same issues in the mid-2011, Commissioner Rodoljub Sabic also said the following:
