Completed investigation into "Belgrade senior cards" case

The Commissioner for Information of Public Importance and Personal Data Protection completed the investigation into the implementation of the Law on Personal Data Protection by the Belgrade City Administration, launched into the personal data processing for the purpose of issuing the so-called "Belgrade senior cards".

The Commissioner issued a Warning on irregularities in personal data processing and ordered the City Administration to inform him within 15 days of all actions to be taken to remedy the irregularities.

The Commissioner also filed a motion for instituting misdemeanor proceedings against the Head of the Belgrade City Administration. Circumstances indicate that the majority of observed omissions result from decisions made outside the administration, in an inadequate procedure and without the necessary formal instruments, however the motion for instituting misdemeanor proceedings was filed against the Head, since the Head had been designated as a responsible person under the law.

The investigation found and it was noted in the Record that the Administration processed data on the Unique Citizen ID Number even though the data was unnecessary, unsuitable and disproportionate for the purpose of processing, and the "explanation" that the processing happened due to an "omission" is quite unacceptable.

There are more than enough problems with personal data protection, without new ones popping up

The Commissioner for Information of Public Importance and Personal Data Protection assesses and warns that it is wrong to continue the Government of Serbia’ practice of settling and submitting certain bills to the National Assembly for adoption without seeking the Commissioner's opinion, contrary to its Rules of Procedure and the law, even though these bills include, inter alia, personal data processing. This may result in not only "abstract" violation of the constitutionality principle due to the adoption of legal norms contrary to constitutional provisions, but also in the concrete, continuous threat to the right to personal data protection in the implementation of laws after adoption.

Has the Draft Law on personal data protection really been finalized?

Numerous journalists contacted the Commissioner for Information of Public Importance and Personal Data Protection on the occasion of the news about the "finalization of the Draft Law on Personal Data Protection", which was published yesterday by Tanjug, RTS, and a host of other media, requesting a commentary on the news and on the contents of the Draft.

In this regard, the Commissioner announces that he cannot verify the news, and journalists and the media should seek the information on whether the Draft is indeed finalized and the information on its content, from the Ministry of Justice, the Working Group of which was tasked to prepare the Draft Law. All the more so, since contradictory statements of the Minister of Justice and her assistant about the said Draft have been furnished to the public.

PROCESSING OF PERSONAL DATA IN THE HEALTH SECTOR - A PROBLEM WHICH CALLS FOR SERIOUS SOLUTIONS, NOT IMPROVISION

The Commissioner for Information on Public Importance and Personal Data Protection, regarding the Bill amending the Law on Health Documentation and Records, submitted by the Government to the National Assembly, gave his opinion on several occasions during the preparation of the Draft Law, to the Ministry of Health which prepared it.

The Serbian Government, in establishing the Bill, ignored the main and essential objection of the Commissioner.
