Commissioner asks the Ministry of Justice to take measures to eliminate contradictional legal solutions

The Commissioner for Information of Public Importance and Personal Data Protection in the letter addressed to the Ministry of Justice asked from the Ministry to take steps to eliminate inconsistent, mutually contradictory solutions in certain laws that are the source of the dilemma regarding the right to personal data protection and a constant source of violation of that right.

Heads of health institutions have addressed the Commissioner confronted with requests from the police and prosecutor's offices, referring to the Code of Criminal Procedure or the Law on Prevention of Domestic Violence, to make available to them information on the state of health of patients, which, in view of the provisions of the Law on Patients' Rights cause dilemmas - whether they can give these data on request or can only give them with the consent of the patient, or on the basis of a court decision.

Prosecutor’s office keeps undermining its reputation

The Commissioner for Information of Public Importance and Personal Data Protection issued an execution ruling, which, under the threat of fines, called on the Higher Public Prosecutor's Office in Belgrade to provide journalist of Pistaljka Portal within two days with the information requested in connection with the case against Sinisa Mali, which will show following:

- the reference number of the said case, what are criminal charges in this case and, in what stage it is, the actions the Prosecutor’s Office has undertaken in the case, and whether Sinisa Mali was interrogated and when,

- what the Prosecutor’s Office has undertaken regarding the 2016 Anti-Corruption Agency Report,

- when the Prosecutor’s Office received a report by the Administration for the Prevention of Money Laundering on the control of financial activities of Sinisa Mali, which the Administration conducted upon the request of Hypo Alpe-Adria Bank in 2009 and what was undertaken in this regard.

Commissioner finalizes oversight in National Assembly

The Commissioner for Information of Public Importance and Personal Data Protection has completed oversight over the implementation and enforcement of the Law on Personal Data Protection by the National Assembly of the Republic of Serbia initiated upon the request of a group of employees within the National Assembly.

The Commissioner was requested to take necessary action, i.e. verify the allegations contained the text in circulation in the media “that an unauthorized person entered the Human Resources Office in August 2017 and took photocopies of the files of the majority of employees.”

In order to properly and completely determine the facts, the persons authorized by the Commissioner requested to examine and examined all the necessary documentation and took oral statements from the competent officers in the National Assembly, which of records were compiled.

Right to access the information held by authorities – a personal citizen right

Commissioner for Information of Public Importance and Personal Data Protection estimates that it is necessary for all authorities and holders of public offices to respect public rights in a manner that would be in accordance with the constitutional and legal guarantees of these rights. The Commissioner reminds that Article 51, of the Constitution, provides that everyone has the right to information access held by the state bodies, in accordance with the law, and that the Law on Free Access to Information of Public Importance regulates the manner of exercising that right.
