Personal data protection – daily task of the responsible

Commissioner for Information of Public Importance and Personal Data Protection has been notified by the Republican Fund for Health Insurance that the branch office of the Fund for Macva District, acting on the Commissioner's ruling, deleted personal data contained in medical documentation, which data had been collected without legal grounds.

Acting on the Commissioner's ruling, via the committee established for the purpose, the branch office for Macva District has in the course of September in 648 files separated certificates of the need to travel in connection with the use of health care services from medical documentation and then permanently destroyed selected specialist reports and hospital discharge lists.

Action plan for Chapter 23 below expected and required level

01.12.2008.Commissioner for Information of Public Importance and Personal Data Protection has estimated the final version of the Action Plan for Chapter 23, at least when it comes to the areas of freedom of access and protection of personal data, to be significantly below the required and expected level.

The Commissioner has stressed, in particular, with regard to the increased media interest, that the planned expenditure for the alleged improvements in the areas in which he operates, have neither been established at his proposal nor reconciled in collaboration with him, he does not support it, and, on the contrary, he considers it largely irrational and unnecessary.

Liability for unlawful processing of personal data is essential, including criminal liability

Commissioner for Information of Public Importance and Personal Data Protection has warned that it is high time for the authorities to start much more responsibly, and more adequately to respond to the fact that an alarming amount of personal data is appearing in the public in general, especially in the media, which data can more than reasonably be assumed to originate from the data files, which have been established and maintained pursuant to law, disposed of by public authorities.

It is intolerable that those responsible and liable continuously ignore the presence of enormous amounts of personal data in the media, inter alia, even of data from the medical records, the results of polygraph testing, full content of the statements of detained witnesses, full data of suspects, crime victims, etc. which are considered "highly sensitive data" pursuant to the Law. This situation is particularly alarming if one bears in mind that the attempt of the media to obtain them through legal means, by exercising the rights derived from the Law on Free Access to Information, would almost certainly be rejected with reference to the fact that it is "confidential" or "so that this would not jeopardize the course of the proceedings".

Serbian Laws apply to all that wish to work in it

Commissioner for Information of Public Importance and Personal Data Protection has launched an ex officio investigation of the implementation of the said Law by "EAGLE HILLS PROPERTIES" d.o.o. pursuant to Article 54 of the Law on Personal Data Protection.

On the basis of the information received from citizens and the content of the electronic message posted on the Internet it can be concluded that "EAGLE HILLS PROPERTIES" d.o.o. requests and obtains copies of personal documents of interested parties (passport or ID cards) for the purpose of organizing meetings in order to sell apartments, the Commissioner in a letter sent to this Company requested them to reply in writing to several questions, ranging from whether the electronic message that appeared on the Internet is authentic, i.e. what kind of processing of personal data is performed, and then regarding the purpose, the legal grounds for data collection, the amount of collected data, users, the potential transfer of data from the country and so on.
