The Commissioner for Information of Public Importance and Personal Data Protection addresses a large number of citizens and journalists who asked if the video taping of vehicles by JP PUTEVI SRBIJE (the Public Enterprise ROADS OF SERBIA) and the forwarding of the footage to the Ministry of Interior, is a violation of the right to protection of personal data?

In order to eliminate any possible dilemmas, the Commissioner reminds that having passed the Law on Road Traffic Safety, the Assembly of the Republic of Serbia, among other things, authorized the bodies in charge of traffic and police affairs to record traffic for the purpose of documenting traffic offenses (Art. 286, item1), allowing an option to such bodies to authorize for that purpose a road operator, a public enterprise or a traffic recording institution (Art. 286, item 2).

Commissioner for Information of Public Importance and Personal Data Protection, on the occasion of the adoption of the Personal Data Protection Strategy, estimates that the attitude towards the implementation of this strategy is a sad illustration of the generally irresponsible attitude of the state towards the circumstances in the important field, the field of human rights.

The Commissioner reminds that by adopting the Strategy, the Government of Serbia has determined that "it shall adopt the Action Plan for the Implementation of the Strategy, within 90 days from the date of its publication, with defined activities, expected effects, executors of specific tasks and deadlines for the completion of the tasks."

The Commissioner for Information of Public Importance and Personal Data Protection estimates that yesterday's statement given by Igor Becic, the Chairman of the Assembly's Security Supervisory Committee, regarding the Commissioner’s opinion on the Proposed Law on Amendments and Supplements to the Law on BIA, to put it mildly, was frivolous, undoubtedly confirming Becic's complete misunderstanding of the problem, which is under the authority of the Committee he chairs.

The statement "unfair and hypocritical coming from Sabic, who has passed the security check and received a certificate for access to classified information, which he boasted about, and to say now that this very procedure is inappropriate", makes just as much sense as, for example, a claim that those who served army must not criticize any bill on the army, hence it makes no sense at all.

On the occasion of addressing a number of journalists and media in response to their interest if the Commissioner was familiar with the content of the Draft Law on Amendments and Supplements to the Law on BIA, whose adoption was proposed by urgent procedure, and what his opinion regarding the Proposal was, the Commissioner for Information of Public Importance and Personal Data Protection informed the public that the content of the Draft Law was known and that in the stage of the drafting, he gave his opinion twice about its contents, to the Proponent.

In Commissioner's opinion, several critical observations and warnings were reported.

The Commissioner's main remarks were related to solutions that regulate security checks and to resolutions regulating the mode of determining the data confidentiality.
