The Commissioner for Information of Public Importance and Personal Data Protection received a statement of the Ministry of Interior (MIA) on measures undertaken and planned activities following the Warning which the Commissioner had sent last month, after completed supervision to MIA, regarding processing of citizens’ personal data of those with "F" diagnosis, as well as processing of some other personal data without valid legal grounds.

The Commissioner evaluates as good and correct reaction, that, as the statement of MIA states "Police Directorate, Police Administration and Traffic Police Administration have started work on the preparation of proposal for Mandatory Instruction on the Method of Organizing the Work in Safety Sectors and Police Departments, having for their aim permanent elimination of irregularities quoted in the Warning of the Commissioner for Information of Public Importance and Personal Data Protection."

The Commissioner for Information of Public Importance and Personal Data Protection, Rodoljub Šabić, has sent a letter today in response to the document sent by the Chairman of the Committee on Judiciary, Public Administration and Local Self-Government of the National Assembly, Petar Petrović informing him that the Assembly Committee "decided to withdraw the proposal of the candidate for the election of the member of the Board of the Anti-Corruption Agency jointly filed jointly by the Protector of Citizens and the Commissioner for Information of Public Importance and Personal Data Protection."

The Commissioner expressed a complete lack of understanding for this action of the Committee, pointing out that the relevant provision of Article 51 of the Rules of Procedure of the National Assembly, to which the Committee referred to, is explicit and clear, and reads: "The Committee gives an opinion on the proposed decision on the election and dismissal of other officials, in accordance with the law ".

The Commissioner for Information of Public Importance and Personal Data Protection presented the Government with the Model of the new Personal Data Protection Law, along with the letter to Prime Minister of the Government of the Republic of Serbia, Ana Brnabić.

The need for the adoption of the new Personal Data Protection Law has been evident for a long time, and it is indisputable at least "on paper", since the formation of the Government Working Group mandated with this task in 2012.

The Commissioner for Information of Public Importance and Personal Data Protection, due to the interest of a large number of the media in whether and how he will react to the publicly-used personal data from the official documentation of the Ministry of Defense and the Ministry of Internal Affairs in the yesterday's parliamentary debate, states that he has ordered supervision over the implementation of the Personal Data Protection Law in both ministries.

The type of personal data and the manner in which they were used indicate that officials in the Ministry of Defense for sure, and in the Ministry of Internal Affairs very likely, violated the provisions of the Personal Data Protection Law and thus committed punishable misdemeanors, by making the personal data disposed by them for statutory purposes available to the third, unauthorized person.
