The Commissioner for Information of Public Importance and Personal Data Protection has sent a Warning to the Ministry of Interior (MoI) regarding irregularities in the implementation of the on Personal Data Protection Law (PDPL).

The warning has resulted from the supervision proceedings instituted and conducted by the Commissioner regarding the request of the Police Department in Kikinda that the hospital provide to it personal data of all citizens who are treated based on the diagnosis code "F". In the document of the police department under which the data are requested it is indicated that the data are necessary "in order to act in accordance with the Instructions on the Manner of Organization and Conduct of Internal Affairs in the Security Sector, and to adequately update the sector's file."

The Commissioner for Information of Public Importance and Personal Data Protection has submitted the request to the Government of the Republic of Serbia, in accordance with Article 28, paragraph 4 of the Law on Free Access to Information of Public Importance, to ensure the enforcement of his decision, by direct coercion, ordering the Anti-Corruption Agency to provide the anti-corruption portal Pistaljka copies of documents from the case file relating to the control of assets and income of the Mayor of Belgrade Sinisa Mali. The Agency failed to act upon the said decision even after paying the 200,000 RSD fine imposed by the Commissioner.

The Commissioner for Information of Public Importance and Personal Data Protection estimates that the "Initiative for urgent adoption of the new Law on Personal Data Protection", which has been submitted by a large group of non-governmental organizations, is an expression and confirmation of the responsible attitude of the non-governmental sector towards the serious and very complex issue which our country has been faced with for too long.

The Commissioner for Information of Public Importance and Personal Data Protection has, pursuant to Articles 39 and 57 of the Law on General Administrative Proceedings (LAP), published on his web site e-mail addresses through which he receives submissions of the parties, and the names of authorized officials of the Commissioner, who take decisions on administrative matters, or conduct proceedings and take certain actions in administrative matters.
