The Commissioner for Information of Public Importance and Personal Data Protection has sent a Letter of Warning to the National Employment Service (NES) for its failure to undertake appropriate measures to protect the personal data contained in the electronic “Single Information System of Records of Unemployed Persons and Recipients of Unemployment Benefits” (SIS) which has resulted in the data contained in those records being freely available to third parties.

Many citizens, media, NGOs and representatives of political parties have asked the Commissioner for Information of Public Importance and Personal Data Protection for clarification as to whether public notaries have the status of public authorities within the meaning of Article 3 of the Law on Free Access to Information of Public Importance (LFAIPI), whether the duties provided for in that Law applied to them and whether it was possible to file complaints against them or seek protection of rights by the Commissioner to obtain access to information.

The Commissioner for Information of Public Importance and Personal Data Protection has fined the Higher Public Prosecutor’s Office of Belgrade for failure to comply with the Commissioner’s orders in three cases in which freedom of information requests had been submitted in connection with the “Savamala” case. The freedom of information requests related to the professional resume of the case prosecutor; information on whether criminal charges had been brought against the persons who failed to comply with the prosecutor’s requests during the investigation; and information whether disciplinary action had been taken against those persons and, if so, the reference numbers of the documents by which such disciplinary action had been initiated.

The Commissioner for Information of Public Importance and Personal Data Protection has passed a decision ordering the Ministry of Health of the Republic of Serbia to put in place organisational, technical and human resources measures immediately after receiving the decision and in any case not later than 8 days of its receipt in order to protect the personal data it processes in the Integrated Health Information System (IHIS) from abuse, destruction, loss, tampering or unauthorised access.
