After several media published information that the Tax Administration would, in the process of determining apartment lending taxes, process personal data of citizens obtained in the population census and held by the Statistical Office of the Republic of Serbia, the Commissioner for Information of Public Importance and Personal Data Protection has initiated a supervision procedure over the implementation of the Law on Personal Data Protection in both of these institutions.

Starting from the premise that such processing of personal data would be contrary to the Law on Personal Data Protection, as well as to the Law on the Census of Population, Households and Dwellings, the Commissioner requested a written statement from both institutions.

The Commissioner for Information of Public Importance and Personal Data Protection, Rodoljub Sabic, has sent a warning to the company Perutnina Ptuj-Topiko d.o.o. (ltd.) from Backa Topola for unauthorized personal data processing during a polygraph testing of 17 employees, since the company had no valid legal basis for such processing and the response was not proportionate to a legitimate purpose.

The company shall, within 15 days as of receipt of the warning, notify the Commissioner of the measures taken in order to prevent further unauthorized processing so that he can decide on possible further measures within his authorities.

The Commissioner for Information of Public Importance and Personal Data Protection ordered by a decision to the Ministry of Labour, Employment, Veteran and Social Affairs, to provide without delay, and within maximum 5 days, information on inspections carried out in factories "Yura" in Raca, Nis and Leskovac in the period from March 2010 to 6 May 2016, as well as information on whether the Nis department of Labour Inspection received cars as presents from "Yura corporation", to the journalist of the daily newspaper "Danas".

The Ministry is obliged to inform the Commissioner of the implementation of the decision within 7 days of its receipt.

On the occasion of publication of personal data from the investigation of rape and murder of a minor A.S. from Vratarnica near Zajecar in several daily newspapers, the Commissioner for Information of Public Importance and Personal Data Protection initiated the supervision procedure over implementation of the Law on Personal Data Protection in the Ministry of the Interior.

Persons authorized by the Commissioner will start a supervision procedure today in the premises of the Ministry in Belgrade. With regard to the sort and amount of data made available, a supervision procedure may also be initiated, if necessary, in the Higher Public Prosecutor' Office in Zajecar, competent in the case of A.S.
