the Commissioner for Information of Public Importance and Personal Data Protection estimates that it is good, normal and expected that the High Judicial Council and the Serbian Medical Chamber withdrew from signing the Memorandum of association of the Medical Chamber of Serbia (MCS) and High Judicial Council (HJC) planned for yesterday, following the letter from the Commissioner.

In his letter and with a view to acting preventively and hindering undesirable consequences of unlawful processing of personal data, the Commissioner pointed out that the content of the abovementioned Memorandum that had envisaged the obligation of the HJC to obtain final decisions reached against healthcare workers, i.e. doctors, from courts of first instance and to inform the MCS afterwards would constitute unlawful processing of personal data contrary to the Law on Personal Data Protection.

The Commissioner for Information of Public Importance and Personal Data Protection estimates that with regard to personal data protection, the Negotiating position of the Republic of Serbia for the intergovernmental accession conference on opening Chapter 23, is inferior to Serbia's actual needs and to what it is obliged and capable of performing in this area.

It is disquieting that the content of this document, adopted by the Government recently, indicates that taking measures that should have already been taken, not only for the sake of the EU accession negotiations, but more importantly, for the sake of protection of our citizens' constitutionally and legally determined rights will further continue to be delayed indefinitely.

After he learned that a large number of citizens received in their personal name and on their home addresses advertising material on sale of apartments in the residential facility "BW Residences" ("Belgrade Waterfront") and after suspicion arose that a personal database was used for this purpose without a proper basis and outside the purpose for which it was intended, the Commissioner for Information of Public Importance and Personal Data Protection initiated and conducted inspection.

Since logos "Belgrade Waterfront", "XYZ" and "EagleHills" were displayed on the advertising materials, inspection was carried out in companies "Beograd na vodi" d.o.o. and "Sportina" d.o.o. which sells the "XYZ" brand.

Commissioner for Information of Public Importance and Personal Data Protection estimates as justified the complaints of citizens dissatisfied with the content of the Certificate of Temporary Incapacity for Work issued by doctors, and submitted to employers. The citizens' dissatisfaction with the contents of this Certificate is founded since it, contrary to the Law on Personal Data Protection, provides for excess and disproportionate processing of some personal data, including particularly sensitive data.
