The Commissioner for Information of Public Importance and Personal Data Protection appraises that the Clinical Center of Serbia with its yesterday's announcement in which, among other things, states that it has obtained the consent of Jovanka Broz for publishing particularly sensitive data on her medical condition, could, at least to some extent, to misinform the public.

The inspection supervision performed by authorized officers of the Commissioner directly in the Clinical Center, showed that there is no consent that could be considered relevant in accordance with the provisions of the Law on Personal Data Protection and the Law on Patient's Rights.

In this context, the Commissioner also said the following:

The Commissioner for Information of Public Importance and Personal Data Protection, ex officio, pursuant to Article 54 (2) in relation to paragraph 1 of the Law on Personal Data Protection ("Official Gazette of RS", no. 97/08 and 104/09 – other law and 68/12 – decision of the CC and 107/12), has initiated the inspection procedure over the implementation and enforcement of this law in the Clinical Center of Serbia, on the occasion of media coverage of the health condition of Mrs. Jovanka Broz.

The Clinical Center of Serbia was ordered to give comment on relevant circumstances concerning the manner in which they made ​​available to the public data on the health condition of Jovanka Broz who are, under the law, "particularly sensitive data", as well as the legal basis for such action, immediately and not later than three days after receipt of the notice, under threat of consequences of failure referred to in Article 57 (1) 16) of the Law on Personal Data Protection.

The Commissioner for Information of Public Importance and Personal Data Protection assesses the situation regarding media coverage of Jovanka Broz's health condition as another alarming warning to completely inappropriate attitude towards personal data protection, in this case in the health care system, but also in general.

In this context, the Commissioner said the following:

Commissioner for Information of Public Importance and Personal Data Processing is issuing a public warning to all business banks, which without legal authority or consent of the natural person whose data are processed, under contracts on business collaboration with the Republican Pension and Disability Insurance Fund make available the data on holders of current accounts or the data of third persons to the Fund, that such action is contrary to the provisions of Articles 8 and 13 of the Law on Personal Data Protection (LPDP) and constitutes inadmissible data processing.

Emphasizing that he has sent an adequate warning to the PDI Fund back in May this year, the Commissioner, Rodoljub Sabic, has stated the following:
